TERMS OF USE FOR THE KAPITALAC CLUB LOYALTY PROGRAM
Bar d.o.o. establishes the following:
GENERAL TERMS AND CONDITIONS OF THE KAPITALAC CLUB LOYALTY PROGRAM
ARTICLE 1
The words and expressions mentioned in the General Terms and Conditions have the following meanings:
Individual Profile - the user's profile in the Kapitalac Club loyalty program, which contains certain personal data collected when filling out the registration form for the loyalty program of Bar d.o.o.
User – a member of the loyalty program who, by making purchases at the Kapitalac physical store, gains various benefits clearly defined by Bar d.o.o.
Store – the sales location of Kapitalac (Vijenac 107. brigade HV 1)
Order – making a purchase at the Kapitalac physical store (does not apply to purchases in the Kapitalac online store)
Contract – the contract concluded between Bar d.o.o. as the seller and the customer within the organized sales system, in accordance with these General Terms and Conditions, which the customer explicitly accepts by filling out the form to participate in the loyalty program. The General Terms and Conditions are considered an integral part of the contract.
ARTICLE 2
(1) By creating an Individual Profile through the online form or the physical form available in the store, the user accepts the General Terms and Conditions and becomes a member of the Kapitalac Club loyalty program, thereby gaining the right to benefits. The loyalty card becomes valid 24 hours after filling out the form.
(2) These General Terms and Conditions regulate the contractual relationship between the user of the Kapitalac Club loyalty program and Bar d.o.o.
(3) Only an adult person can be a user of the Kapitalac Club loyalty program.
(4) The Kapitalac Club loyalty program is intended for personal and consumer use only. The benefits awarded by the loyalty program must not be used for any business transactions or purposes.
CONTRACTUAL PERIOD AND AVAILABILITY OF THE PROGRAM
ARTICLE 3
The contract is concluded for an indefinite period and enters into force on the day of acceptance of these General Terms and Conditions.
(1) Users of the Kapitalac Club loyalty program guarantee that all data provided to Bar d.o.o. for the purpose of obtaining membership in the loyalty program is accurate. The user assumes responsibility for any inaccurate, incomplete, or outdated information.
CREATION OF AN INDIVIDUAL PROFILE.
ARTICLE 4
(1) The user agrees to provide accurate personal data for the purpose of creating an Individual Profile and joining the Kapitalac Club loyalty program.
(2) Upon creating the Individual Profile, the user is assigned a serial number.
(3) The user is obliged to update any changes to their personal data either in person at the Kapitalac store or by email at [email protected].
(4) Bar d.o.o. will not be liable for any damage due to untimely updating of personal data changes.
HOW TO ACCESS THE BENEFITS OF THE KAPITALAC CLUB LOYALTY PROGRAM?
ARTICLE 5
(1) The benefits offered by Bar d.o.o. are available only to registered users.
(2) By creating an Individual Profile and accepting the General Terms and Conditions, an adult natural person becomes a member of the Kapitalac Club loyalty program, which is confirmed by a confirmation email or written confirmation of successful registration and creation of the individual profile.
(3) By making a purchase at the Kapitalac store, the user gains the right to use the benefits. During the purchase, the user must prove their membership in the Kapitalac Club loyalty program by presenting the barcode of their personal user account (by scanning the barcode or entering the card number at the time of purchase).
(4) Bar d.o.o. commits to maintaining and coordinating the Loyalty Program platform and taking all security and organizational measures to prevent fraudulent and dishonest actions.
WHAT BENEFITS DOES A REGISTERED USER OF THE KAPITALAC CLUB LOYALTY PROGRAM RECEIVE?
1. Discounts – the user receives special benefits in the form of discounts on certain products. To use these special benefits, the customer must present their loyalty card containing a barcode to the retailer. The customer can also have a digital code that can replace the physical card and must present it to the retailer on their mobile device screen. A customer who does not scan their card at the time of purchase in the store will not qualify for the loyalty program benefits through their purchase.
2. Personalized communication – when filling out the form to participate in the loyalty program, the user can give their consent to receive personalized content, discounts, and offers. The user is not required to receive notifications, personalized content, discounts, offers, and other benefits from Bar d.o.o.
PROTECTION OF PERSONAL DATA
ARTICLE 6
Bar d.o.o. will ensure the user's privacy and protection of personal data entered through the registration form for the Kapitalac Club loyalty program. At the moment of accepting the terms, the user is informed of their right to withdraw the statement of consent at any time. The user is responsible for all actions and orders made with the Kapitalac Club card. Any type of communication from the Customer/User is not considered confidential.
PRODUCT INFORMATION
ARTICLE 7
Bar d.o.o. reserves the right to use different prices in the online store (https://kapitalac.com/) and in the Kapitalac physical store. For Kapitalac Club card users, the valid price will be the one currently listed in the physical store.
WITHDRAWAL FROM KAPITALAC CLUB
ARTICLE 8
The user has the right to withdraw from the Kapitalac Club loyalty program at any time. A user who no longer wishes to be part of the Kapitalac Club must report their decision via email to [email protected] or in writing to the company's address (Bar d.o.o., Vijenac 107 Brigade HV 1, 31550 Valpovo). In the case of user inactivity for a period of five (5) years from the date of last use, the user card will be canceled and all data stored in the account will be deleted.
